IMPORTANT: Please note that you cannot attend coaching or consulting sessions with Melissa Montalvo or any other coach/consultant from The Academy of Human Potential, LLC without reviewing and agreeing to the following terms and conditions. Thank you in advance!

This agreement is between Melissa Montalvo of The Academy of Human Potential, LLC (The Coach/Consultant) and YOUR NAME (The Client) for the purposes of outlining the terms and conditions for coaching or consulting with The Academy of Human Potential, LLC and any coach or consultant contracted by the company.

I. INDEMNITY:

By hiring The Coach/Consultant, The Client is representing themselves as a competent, effective individual who is fully able to make their own personal and business decisions and choices, including decisions and choices The Client may make as a result of this coaching/consulting process. The Client represents themselves and their company as being able to operate fully, freely, and responsibly for all of The Client’s business decisions and actions.

By confirming to this agreement, The Client is agreeing that any actions they or their company takes as a result of The Coach/Consultant’s input, coaching, consulting, programs, speaking, training or development are The Client’s actions and The Client’s actions alone. The Client alone is responsible completely and fully for the outcomes, results and any liabilities that arise from taking those actions. The Client waives all claims of any type whatsoever that The Client may have against The Coach/Consultant arising out of or in connection with any claims or lawsuits against The Client or liabilities or damages of any sort incurred by The Client related to any actions The Client takes or decisions The Client makes as a result of The Coach/Consultant’s input, coaching or consulting, programs, speaking, training, books or development.

II. COPYRIGHT AND OWNERSHIP:

The Client understands that all material presented in The Coach/Consultant process are copyrighted or licensed by The Academy of Human Potential, LLC/The Coach/Consultant. The Client promises that any notes The Client takes will be for the The Client’s personal and professional use only. The Client will not resell any of The Coach/Consultant distinctions and material without the prior written consent of The Coach/Consultant. Furthermore, The Client will not attempt to coach other individuals by using the principles and methodologies employed in The Coach/Consultant relationship without the prior written consent of The Coach/Consultant.

III. PRIVACY AND CONFIDENTIALITY:

When The Client seeks the advice of the The Coach/Consultant, it will stay between The Client and The Coach/Consultant. The Coach/Consultant will not disclose personal or business information to others ever. All input provided to The Coach/Consultant during sessions and via the work done by The Client will remain private and confidential.

The Coach/Consultant has the right and should they choose to share examples of progress as an uplifting story and inspiration to help others (in books, articles, lectures,  workshops, other mediums) all names, locations and personal information will be void as to protect The Client’s privacy (unless asked for permission) and they will not be recognized in the example.

IV. CANCELLATION POLICY:

Please be advised that canceling sessions is not recommended, but we understand some events are out of our daily control. Should you need to cancel your planned appointment, please use the online scheduler to cancel at least 24 hours before your session, and please reschedule your session within seven days, one week of the cancellation date. If you reach out to us ahead of time, you will not be charged for the first missed appointment. However, if you miss more than one appointment, without communication you will lose that session and not be refunded nor will you be able to make up the missed appointment. In case of illness or family emergencies, please communicate with our team if you need to put your sessions on hold. The sessions are not refundable but you can defer them up to 3 years.

V. EXPIRATION DATE:

From the time of purchase, you will have 6 months to start your sessions. They will not expire if you communicate with us, but all sessions will expire 365 days after payment is received if you are inactive in the calendar system. If you communicate with us, you may roll the sessions over into the next calendar year. It is best to use your sessions weekly or every other week. If something comes up and you need to put your sessions on hold please email [email protected] to arrange an agreed-upon plan.

VI. PAYMENT REFUND POLICY:

Due to the nature of this business, all Coaching/Consulting/Programs are non-refundable on promotional period investments unless stated otherwise. (If you signed up with a promotion code or during a promotion period no refunds will be given.)

Money Back Guarantee: If you paid in full (not during a promotion) and after the first session you don’t find value, you will get your investment back (minus coaching/consulting time and session used). In order to receive a refund, The Client must do the activities and give the process their full effort and send to The Coach/Consultant for review. If The Coach/Consultant program is not a right fit after this, you may request a refund.

VII. DISCLAIMER:

By paying for or accepting a coaching/consulting session you agree that the advice you receive is not a substitute for treatment from a licensed medical, psychological, legal or financial professional. We provide no guarantees, warranties and are not responsible for any interpretations, decisions made or actions taken by The Client.

VIII. NONDISCRIMIINATION NOTICE:

The Academy of Human Potential, LLC services and all programs follow federal civil rights laws. We do not discriminate based on race, color, national origin, age, disability, gender, gender identity, sex or sexual orientation.
